Preamble
These general terms and conditions of sale (GTCS) apply to the booking of rooms or the privatisation of all or some of the rooms at Villa Caormina located at 1782 Route du Théron 46220 PRAYSSAC. These terms and conditions are those in force on the date of confirmation of the reservation online or by telephone. They are deemed to have been read and accepted by the customer. Villa Caormina is reserved for adults and, if privatised, accepts minors of at least 15 years of age. Couples with infants are accepted provided they inform the owners at the time of booking.
Owners undertake to welcome guests personally (Art. D 324-13 of the French Tourism Code), to guarantee them a pleasant stay in the best possible conditions and to help them get to know the region and its heritage.
The Owner undertakes not to divulge to any third party any information of any kind whatsoever, on any medium whatsoever, that the Tenant may provide to the Owner in the performance of this contract. However, these provisions do not apply to requests for information made by the authorities and/or the courts.
Article 1 - Length of stay
The tenant who has reached the age of majority and signs this contract, concluded for a fixed period, may under no circumstances claim any right to remain in the property at the end of the stay.
Any extension of the stay at the customer's request can only be considered with the exclusive agreement of the owners and the signing of a new contract, subject to the availability of the accommodation.
Article 2 - Booking and prices
Our prices are per night or per week, depending on the type of booking: bed and breakfast or private use of the entire Villa Caormina.
No retraction
For bookings made by telephone or online on the website, the hirer does not benefit from the withdrawal period. Article L.121-20-4 of the French Consumer Code states that the provisions of article L. 121-20 of this code, relating to the right of withdrawal, do not apply to the provision of accommodation services that must be provided on a specific date or at a specific time.
Booking your stay
The reservation becomes effective once the customer has sent the owner a deposit of 50 % of the total price of the stay by bank transfer and a copy of the signed contract. The second copy of the contract must be kept by the customer. Prices include all charges but exclude tourist tax.
For stays booked less than 30 days before the date of arrival, 100% of the booking fee will be charged.
Rules for your stay
Tourist tax
Tourist tax is a local tax that customers must pay to the service provider, who then passes it on to the Communauté de Communes de la Vallée du Lot et du Vignoble. It is currently set at €0.98 (bed and breakfast) per adult per night for the total duration of the stay. The tax is 4.5% + additional taxes for privatisation. It is payable by the customer on presentation of the invoice.
Security deposit
The amount of the security deposit will be at most equivalent to that of the rental, without being able to exceed one month. It may be cashed by cheque or bank transfer at the time of the entry inspection. The deposit will be returned or reimbursed on the day of departure, except in cases where damage has been noted to the rented property (see the inventory on departure). The security deposit is used to cover any costs incurred in restoring missing or damaged equipment during the stay. The customer undertakes to declare any damage, however slight, as soon as possible to enable the damage to be limited or any other protective measures to be taken, and at the latest before departure.
Article 3 - Conditions of stay
Arrivals
The customer must arrive on the day and at the time specified in this contract. In the event of late or delayed arrival, the customer must inform the owner so that everything is ready on arrival.
No reduction will be granted for late arrivals. Early arrivals, for example to drop off luggage, are subject to prior agreement.
Departures
On the day of departure, customers are asked to vacate the room or private villa by 10.30 am at the latest, after the keys have been handed over.
An extra day will be charged if this time is not respected. Customers are requested to declare any damage, breakage or loss, however minor, before leaving. No discount will be granted for early departure.
Capacity
Villa Caormina has 4 bedrooms for a total capacity of 8 people. Under no circumstances may the number of occupants exceed this capacity, even for a day. Otherwise, the owners may refuse to accept additional guests. Access to the swimming pool and outdoor areas is strictly reserved for guests staying at Villa Caormina.
Under no circumstances may the rental be used, even partially, by third parties, except with the written agreement of the owners. Any breach of this provision may result in the immediate termination of the rental agreement to your detriment, with the proceeds of the rental remaining the property of the owners.
Animals
Pets are not allowed (unless agreed in advance and exceptionally specified on the contract - for example, guide and assistance dogs will be accepted).
If the customer fails to comply with this clause, the owner may refuse the holiday. This refusal can in no way be considered as a modification or breach of contract at the owner's initiative, so that in the event of the customer's departure, the rental price remains the property of the owner and no refund will be made.
Article 4 - Use of the premises
Peace and quiet
Villa Caormina is located in the countryside but in a residential area. The peaceful nature of the premises must be respected, as must the neighbourhood. For the well-being of others and of the owners living nearby, we ask you to reduce the noise outside after 10 p.m.
It is forbidden to organise events, parties or receptions of any kind in the rented property. In the event of non-compliance with this rule, the owners reserve the right to terminate the rental.
Access to the swimming pool
The pool is open every day from May to September, between 9am and 9pm. Swimming is unsupervised (pool alarm). Minors are therefore under the exclusive care and supervision of their parents.
The owners reserve the right to refuse access to the swimming pool if there is any doubt about the quality of the water. More generally, guests undertake to comply scrupulously with all the owner's instructions regarding access to and use of the pool area. The swimming pool area is a place of tranquillity and relaxation. It is strictly forbidden to run around the pool, to dive or to play rough.
Respect for the environment
The tenant undertakes to leave the rented property as clean and in the same condition as he/she found it on arrival. It is forbidden to consume food or drink in the rooms. The tenant undertakes to respect the premises and all the furniture and equipment therein, including the handmade carpets and decoration. For the same reasons, interior and exterior furniture may not be moved.
Special care instructions for delicate surfaces (solid wood and stone floors, sinks, basins, shower trays and toilets) are detailed in the welcome booklet.
New, top-of-the-range household appliances are provided. Please use them with care and return them in a clean and tidy condition. In the event of abnormal soiling, a cleaning service supplement will be invoiced.
Normal wear and tear is generally tolerated (a chip, broken glass). Beyond this, any damage, negligence or significant breakage will be deducted from the security deposit, taking into account the replacement value.
No smoking inside the building. For reasons of safety and comfort, smoking is strictly prohibited in the guest house. Ashtrays are available outside.
Non-collective sanitation
The rented property is not connected to a public sewerage system and therefore has a private septic tank. It is strictly forbidden to use chemical products (bleach, white spirit, etc.) and to throw into the WC or sinks any solid object or the following waste: condoms, periodical tampons, cigarettes, cotton wool, cotton buds, nappies, sanitary towels, teats, bottles, flasks, cloth, stones, etc. In the event of non-compliance with these rules and if a specialist company has to be called in, the cost of cleaning up will be the responsibility of the tenant.
Internet access
Villa Caormina provides its guests with free wifi internet access throughout the establishment. The customer undertakes to ensure that the computer resources made available are not used for fraudulent or illegal purposes and in particular in order to commit any act of infringement of third party rights, piracy and/or illegal downloading protected by copyright or neighbouring rights sanctioned by the Intellectual Property Code. The choice to use the Villa Caormina wifi is made under the sole responsibility of the customer and releases the service provider from any liability concerning its use.
Vehicle parking
An uncovered private car park adjoining the property is available. We ask that you do not leave valuables in the vehicles and decline all responsibility in the event of an incident. Parking in the courtyard is permitted during loading and unloading operations. We have a room for bicycles; just let us know when you make your reservation.
Charging stations for electric vehicles will soon be available (installation in progress).
Article 5 - cancellation conditions
By the customer
Owners must be notified of any cancellation or termination as soon as possible by e-mail to contact@villacaormina.com
Any stay that is interrupted or shortened (late arrival, early departure) due to the customer's fault will not be reimbursed.
In the event of serious illness or the death of a close relative, your stay may be postponed to a later date or the cost of your booking may be refunded, subject to presentation of a medical or death certificate.
If the customer does not arrive before 10 p.m. on the date scheduled for the start of the stay, this contract becomes null and void and the owners may dispose of the guest room(s) or the whole of the house rented in privatisation.
By the owner
In the event of external events beyond the customer's control (bad weather, pandemic, state of health, etc.) necessitating the closure of the establishment, the stay may, at the customer's discretion, either be postponed to a later date or be refunded in full. If, for any reason whatsoever, there is a difference in price between the date initially chosen and the rescheduled date, the customer will be required to pay the difference. No additional compensation may be claimed.
Cancellation for inappropriate behaviour or failure to comply with the rules
The owner also reserves the right to terminate the rental for serious reasons: theft, damage, disrespect for other guests, inappropriate behaviour or failure to comply with the house rules. The full amount of the stay will be retained by the owner, without this payment precluding any legal proceedings.
Article 6 - Insurance
The customer is responsible for all damage caused by him/her. The tenant declares that he is covered by an insurance policy that includes the holiday extension (holiday rental) and provides sufficient cover for his liability as a seasonal tenant as well as that of the persons who will share the rented premises with him, for the duration of this contract. A certificate of insurance may be requested.
Article 7 - Disputes
In the event of a dispute, the parties will endeavour to reach an amicable agreement. If no agreement can be reached, the matter will be referred to the competent courts.
Personal data
Pursuant to Law No. 2018-493 of 20 June 2018 on the protection of personal data and the General Data Protection Regulation RGPD, the customer is hereby informed that the information provided at the time of booking is subject to the processing of personal data for the purposes of managing bookings and customers, billing and payment requirements, as well as for commercial prospecting purposes.
During their stay, customers may find themselves photographed or filmed at events organised and attended by them. For commercial purposes, these photos and/or videos may be published on Villa Caormina's social networking sites: website, Facebook, Instagram, etc. Customers have the right to access, rectify and delete their personal data.
They are therefore invited to inform the establishment's service provider during their stay that they do not wish to be filmed or photographed. They may also exercise this right by writing to the following email address after their stay: contact@villacaormina.com or by post to Villa Caormina 1782 Route du Théron 46220 PRAYSSAC. The service provider hereby undertakes not to distribute or delete any photos or films concerning him/her.
